1. Scope
These General Terms and Conditions govern the booking and provision of photography services by Laure Jacquemin, freelance photographer based in Venice, Italy.
By confirming a booking, paying a deposit, or signing a contract, the Client acknowledges and accepts these Terms and Conditions.
2. Service Provider
The Photographer is an independent freelance professional based in Italy and provides photography services for weddings, proposals, engagements, elopements, couple sessions, family sessions, portrait sessions, and related photographic coverage.
3. Contracting Party
The contract and invoice shall be issued in the name of the person who signs the contract and makes the payment.
That person is considered the Client and is legally responsible for the booking, payments, and compliance with these Terms and Conditions.
If another person is involved in the planning process, such person shall not be considered the contracting party unless expressly stated in writing.
4. Booking and Date Reservation
A booking is considered confirmed only when:
- the Photographer has confirmed availability in writing,
- the Client has signed the contract, where applicable, and
- the agreed deposit has been received.
Until all required steps are completed, the date remains open and may be offered to other clients.
The Photographer is not obliged to reserve a date without deposit and formal confirmation.
5. Deposit and Payments
A non-refundable booking deposit is required to secure the date.
Unless otherwise agreed in writing:
- the deposit amount is specified in the individual quote or contract,
- the remaining balance shall be paid by the deadline indicated in the contract or invoice.
Payments are accepted by bank transfer only.
The Photographer does not accept payment by credit card or card terminal.
Any bank charges, transfer fees, currency conversion fees, or intermediary banking costs are the responsibility of the Client.
A booking shall be considered secured only when the full deposit amount has been effectively received in the Photographer’s bank account.
6. Prices
All prices are those stated in the Photographer’s written quotation, price list, or contract.
Unless otherwise stated, prices are expressed in euros (EUR).
Any additional services, overtime, transport, entrance fees, water taxi, gondola, assistants, videography, rush delivery, albums, prints, or third-party services are not included unless expressly specified in writing.
7. Client Information for Contract and Invoice
To prepare the contract, invoice, and mandatory administrative documentation, the Photographer may request identification and billing information from the Client, including:
- full name,
- full address,
- date of birth,
- place of birth,
- tax identification number, if applicable.
For foreign private clients who do not have an Italian tax code, equivalent identifying details may be requested for invoicing and record-keeping purposes.
The Client is responsible for ensuring that all information provided is accurate and complete.
8. Nature of the Service
Photography is a creative professional service. The Client acknowledges that:
- the final result depends on timing, weather, lighting, venue rules, transport conditions, crowd levels, and real-life circumstances,
- no specific image, pose, background, guest expression, or exact reproduction of any reference photo can be guaranteed,
- the Photographer retains full artistic discretion regarding shooting approach, image selection, framing, editing style, and final delivery.
9. Coverage Time and Overtime
Coverage begins and ends at the times agreed in writing.
If the event runs late or the Client requests additional coverage, any extension is subject to:
- the Photographer’s availability on the day,
- prior or same-day written confirmation,
- payment of the applicable overtime fee.
If no overtime has been agreed, the Photographer may stop coverage at the scheduled end time.
10. Client Cooperation
The Client shall cooperate fully and provide all relevant information necessary for the correct performance of the service, including:
- schedule,
- addresses and meeting points,
- transport logistics,
- venue restrictions,
- ceremony rules,
- contacts of planners or coordinators where relevant.
The Photographer shall not be liable for missed images caused by delays, lack of information, schedule changes, restricted access, late arrivals, or non-cooperation by the Client, guests, officiants, venue staff, transport providers, or third parties.
11. Permits, Venue Rules, and Third-Party Restrictions
The Client is responsible for ensuring that photography is permitted at the location(s) concerned and for obtaining any required permission, authorisation, pass, access right, or permit, unless expressly agreed otherwise in writing.
The Photographer shall not be responsible for limitations imposed by churches, civil venues, museums, hotels, palaces, islands, gondoliers, boat operators, or public authorities.
12. Weather, Force Majeure, and External Conditions
The Photographer shall not be responsible for delays, restrictions, or impossibility of performance caused by circumstances beyond reasonable control, including but not limited to:
- severe weather,
- acqua alta,
- flooding,
- transport interruption,
- public restrictions,
- strikes,
- civil disorder,
- government measures,
- venue closure,
- medical emergencies,
- force majeure events.
Where reasonably possible, the Photographer will make reasonable efforts to adapt the schedule, route, or shooting plan.
13. Photographer Illness or Serious Incapacity
The Photographer shall personally perform the service.
The only circumstance in which another photographer may be proposed is if the Photographer becomes unable to attend due to a serious and exceptional event, such as illness, accident, or other grave impediment beyond reasonable control.
In such case, the Photographer may, where possible, propose a replacement photographer of professional level reasonably consistent with the booked service. The Client shall remain free to accept or refuse such replacement according to the terms specified in the individual contract.
14. Cancellation by the Client
If the Client cancels the booking, the deposit shall remain retained as compensation for the reservation of the date and the loss of business opportunity.
If cancellation occurs after additional payments have been made, the treatment of such payments shall be governed by the individual contract and the applicable law.
If the Client requests to move the booking to another date, any rescheduling is subject to the Photographer’s availability and written acceptance. A date change is not guaranteed.
15. Cancellation by the Photographer
If the Photographer is unable to perform the service and no replacement solution is agreed, any sums paid by the Client shall be refunded to the extent required by the contract and applicable law, excluding any external third-party costs not received by the Photographer.
The Photographer’s liability shall in any event be limited to the amount actually paid by the Client for the photography service.
16. Right of Withdrawal
Where applicable under mandatory consumer law, the Client may have a statutory right of withdrawal for distance contracts. EU consumer law generally provides a 14-day withdrawal period for distance service contracts, subject to exceptions and to the specific circumstances of the booking.
Because photography services are often booked for a specific date and involve advance reservation, planning, and loss of availability for other clients, the contract and booking flow should be reviewed with Italian legal counsel to ensure that this clause is drafted correctly for the Photographer’s actual business model and booking method. EU law also requires clear pre-contract information.
17. Deliverables
The number of delivered images, duration of coverage, delivery format, and gallery conditions are those stated in the individual package, quotation, or contract.
Unless otherwise specified:
- only edited final images are delivered,
- RAW files are not included and are not delivered,
- image selection is made solely by the Photographer,
- duplicate, test, out-of-focus, blinking, or technically unsuitable images are excluded.
18. Editing Style
The Client acknowledges that they are familiar with the Photographer’s portfolio and accepts the Photographer’s editing style, artistic interpretation, colour rendering, cropping choices, and post-production approach.
No re-editing, style change, or unedited delivery is included unless expressly agreed in writing.
19. Delivery Time
Delivery times are estimates unless expressly stated as binding in writing.
The Photographer shall not be liable for reasonable delays caused by peak season workload, illness, force majeure, technical issues, or circumstances beyond reasonable control.
20. Archiving
The Photographer is not obliged to archive images indefinitely.
Unless otherwise agreed in writing, the Photographer may delete files after a reasonable storage period.
The Client is responsible for downloading and backing up all delivered files promptly after delivery.
21. Copyright
All photographs remain the intellectual property and copyright of the Photographer, unless otherwise required by mandatory law or expressly transferred in writing.
No copyright is transferred to the Client.
The Client receives a personal licence to use the delivered images for private, non-commercial purposes.
22. Client Use of Images
The Client may:
- download,
- print,
- share with family and friends,
- publish on personal social media,
provided that the images are not altered, sold, licensed, submitted to contests, or used for commercial, editorial, advertising, resale, publication, or vendor promotion purposes without prior written permission from the Photographer.
Where reasonably possible, credit to the Photographer is appreciated when images are shared online.
23. Photographer Portfolio Use
Unless otherwise agreed in writing, the Photographer may use selected images for:
- portfolio,
- website,
- blog,
- social media,
- exhibitions,
- studio samples,
- professional promotion.
If the Client requires full confidentiality or restricted publication, this must be requested and agreed in writing before booking.
24. Videography and Third-Party Services
If videography, planner services, transport, gondola, water taxi, flowers, musicians, celebrants, or other third-party services are involved, the Photographer is responsible only for the photography services personally contracted.
The Photographer shall not be liable for the acts, omissions, cancellations, quality, delays, pricing, safety, or performance of third-party suppliers.
25. Meals, Breaks, and Working Conditions
For long continuous coverage, the Client shall ensure reasonable working conditions, including access, timing coordination, and where appropriate, a short break or meal arrangement consistent with the duration and nature of the assignment.
26. Limitation of Liability
To the maximum extent permitted by applicable law, the Photographer shall not be liable for:
- indirect loss,
- emotional disappointment,
- missed opportunities,
- consequential damages,
- acts of third parties,
- circumstances outside reasonable control.
In all cases, any liability of the Photographer shall be limited to the total amount paid by the Client for the booked photography service.
Nothing in these Terms excludes liability where exclusion is prohibited by mandatory law.
27. Data Protection and Privacy
The Photographer processes personal data only insofar as necessary for:
- responding to enquiries,
- preparing quotations,
- concluding and performing the contract,
- invoicing and accounting,
- legal and administrative compliance,
- communication relating to the booked service.
Personal data shall be processed in accordance with applicable data protection law, including the GDPR. Personal data must be adequate, relevant, and limited to what is necessary for the purposes for which they are processed.
The Client may request further information regarding the processing of personal data and any applicable privacy notice.
28. Complaints
Any complaint regarding the service must be made in writing within a reasonable time after the event or delivery, with sufficient detail to allow review.
The parties agree to attempt to resolve any dispute amicably before initiating formal legal proceedings.
29. Governing Law and Jurisdiction
These Terms and Conditions, and any contract concluded with the Photographer, shall be governed by the laws of Italy, subject to any mandatory consumer protection rules that may apply.
Any dispute shall be submitted to the competent court as determined under applicable Italian and EU law.
30. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
31. Entire Agreement
These Terms and Conditions, together with the individual quotation, invoice, and signed contract where applicable, constitute the entire agreement between the parties relating to the photography services.
32. Amendments
No amendment or derogation from these Terms shall be valid unless made in writing.
